What is construction maintenance?

Construction warranty and maintenance is the final stage in construction work.

Construction maintenance is a collection of tasks to ensure and maintain the normal and safe working of the work in accordance with the design regulations during exploitation and use. Contents of construction maintenance may include one, several or all of the following jobs: inspection, monitoring, quality inspection, maintenance and repair of works; supplement or replace work items and equipment so that the exploitation and use of the works are safe, but do not include activities that change the function and scale of the works.

Requirements for construction maintenance

Article 126 of the 2014 Law on Construction (amended 2020) stipulates that the requirements for construction maintenance are regulated as follows:

a) Construction works, construction items when put into use must be maintained;

b) The maintenance process must be established and approved by the investor before the construction works or items are put into use; suitable for the purpose of use, type and grade of construction works, work items, equipment to be built and installed in the works;

c) Maintenance must ensure safety for people, property and structures.

The owner or manager using the building is responsible for the maintenance of the building, construction machinery, and equipment.

Maintenance of construction works and construction equipment must be carried out according to approved maintenance plans and maintenance procedures.

Regulations on construction maintenance procedures

For construction works that have been put into operation and used but have not yet had a maintenance process, the owner or manager or user of the building will organize setting up and approving the construction maintenance process, the construction quality inspection can be organized as a basis for formulating the construction maintenance process if necessary. In the maintenance process, it is necessary to clearly define the remaining useful life of the building, parts, work items, and equipment installed in the work.

It is not required to set up a separate maintenance process for each grade III building or below, separate houses and temporary works, unless otherwise prescribed by law . Owners or managers and users of these works still have to carry out construction maintenance in accordance with this Decree’s regulations on construction maintenance.

The main content of the construction maintenance process

Based on the provisions of Clause 1, Article 31 of Decree 06/2021/ND-CP, the construction maintenance process includes the following main contents:

a) Technical specifications, technology of the building, construction parts and construction equipment;

b) Specifies the object, method and frequency of checking works;

c) Regulations on contents and instructions for maintenance of works in accordance with each building part, type of building and equipment installed in the building;< /p>

d) Specify the time and instructions for periodic replacement of equipment installed in the building;

đ) Instruct methods to repair the damage of the building, handle the case of degraded buildings;

e) Regulations on the use time of works, parts, work items, equipment installed in the works;

g) Regulations on the content, method and time of the first assessment, and the frequency of evaluation for works subject to safety assessment during the exploitation and use. applied in accordance with the provisions of technical regulations, applicable standards and relevant laws;

Article 35 Decree 06/2021/ND-CP stipulates construction maintenance costs as follows:

Construction maintenance cost is the total necessary cost determined according to the requirements of the work that needs to be done in accordance with the maintenance and planning process. approved construction maintenance plan. Maintenance costs may include one, several or all of the cost contents in performing construction maintenance as required by the approved construction maintenance process.

Based on the form of ownership and management of the building, the cost of maintenance is formed from one capital source or a combination of the following sources: : foreign state capital for public investment, state budget capital for recurrent expenditure, revenue from the exploitation and use of construction works; contributions and mobilization of organizations, individuals and other lawful capital sources.
